Terms of Service

These terms apply when you buy from fitfoodz.co.za or use the FitFoodz mobile app. Please read them. By placing an order you agree to them.

Who you are dealing with

SA FITFOODZ (Pty) Ltd, trading as FitFoodz Registration number 2018/559835/07, a private company registered in South Africa VAT registration number 4050298597 77 Walter Sisulu Lane, Miederpark, Potchefstroom, 2531, South Africa [email protected] · 072 522 7099 · https://fitfoodz.co.za

Our full statutory details, in terms of section 43 of the Electronic Communications and Transactions Act 25 of 2002, are at Contact information.

What we sell

Chef-prepared, macro-matched frozen meals, meal packages and related supplements, cooked and packed in our own kitchen in Potchefstroom.

Our meals are food, not medicine. Nutritional information is given in good faith and is accurate to the best of our ability, but it is not medical or dietary advice. If you have a medical condition, an allergy or specific dietary requirements, please speak to a healthcare professional before changing what you eat. If you have a food allergy, contact us before ordering. Our meals are prepared in a kitchen that handles common allergens.

Prices and payment

• Prices are in South African Rand and include VAT at 15%.
• Delivery is charged separately where it applies, and the cost is shown to you before you pay.
• Payment is taken when you place your order.
• We accept card, instant EFT, Apple Pay, Google Pay and Pay Later (pay in instalments), through our payment providers. Card details are entered on the provider's own secure page and are never stored by us.
• We try hard to keep prices and stock accurate. If we have made an obvious pricing error, or a product turns out to be unavailable after you have paid, we will contact you and either supply it at the correct price with your agreement, or refund you in full. We will not simply charge you more.

Your order

A contract comes into existence when we accept your order and take payment. We may decline an order, and refund it in full, where we cannot deliver to your address, where stock is genuinely unavailable, or where we reasonably suspect fraud.

Because meals are cooked and packed to order, we may substitute a meal of equal or greater value within the same range where something is unavailable. Where we do, we tell you.

Delivery

Set out in our Delivery Policy. We confirm your delivery date when your order is dispatched and give you a time window on the day. Risk in the goods passes to you on delivery.

Returns, refunds and your consumer rights

Set out in our Refund Policy. In summary:

• A 48 hour freshness guarantee from delivery.
• Your rights under the Consumer Protection Act 68 of 2008 are untouched by anything in these terms. In particular section 55, the right to goods of good quality and free of defects, and section 56, the right to return defective goods within six months and choose a refund, replacement or repair.
• The seven day cooling-off right in section 44 of the Electronic Communications and Transactions Act does not apply to our meals, because section 42(2) of that Act excludes perishable goods. It is not something we have chosen to exclude.

Your account

You are responsible for keeping your account details secure and for everything done through your account. Tell us immediately if you think someone else has access to it. We may suspend or close an account that is used fraudulently or abusively.

FitFoodz Family and promotions

• FitFoodz Family tiers are based on how many orders you have placed. Tiers do not go backwards. Tier benefits are more food, not deeper discounts, and we may change what a tier includes on reasonable notice.
• Discount codes are single use per customer unless we say otherwise, cannot be exchanged for cash, and cannot normally be combined with another code. Where a code has been used in a way it was clearly not meant to be, we may cancel the order and refund it.
• Store credit and gift cards are credited to your account and can be used against future orders. They are not exchangeable for cash. In line with the Consumer Protection Act, a gift voucher is valid for three years from the date it is issued.

FitFoodz+ membership

FitFoodz+ is a paid monthly membership, separate from the free FitFoodz Family tiers.

• It costs R99 per month, including VAT, and it renews automatically every month until you cancel.
• The first payment is taken when you join, and each renewal is taken on the same date each month.
• We take it by card, using a secure token held by our payment provider. We do not store your card number.
• You can cancel at any time, from inside the FitFoodz app. Cancellation stops the next payment. Your benefits run to the end of the month you have already paid for, and we do not refund part of a month.
• If a payment fails we will retry it and tell you. If it keeps failing we cancel the membership and the benefits stop.
• We may change what the membership includes, or its price, on one month's notice. If we do and you do not want to continue, cancel before the next renewal.

Membership benefits are practical ones, such as free delivery and stock priority. They are not a discount on the meals themselves.

Reviews and content you post

If you post a review, a photograph or anything else, you confirm it is your own, that it is honest, and you give us permission to publish and use it in our marketing. We may remove anything unlawful, abusive or misleading.

Our website and app

We try to keep the Site and the app available and accurate, but we do not promise that they will always be uninterrupted or error free. We may change or withdraw features. All our branding, photography, recipes, text and design remain ours, and you may not copy or reuse them commercially without our written permission.

Liability

We are liable to you as the law requires, and nothing in these terms limits or excludes:

• liability for death or personal injury caused by our negligence
• liability for fraud or fraudulent misrepresentation
• any of your rights under the Consumer Protection Act, which cannot be contracted away
• anything else that cannot lawfully be limited

Subject to that, we are not liable for indirect or consequential loss, and our total liability for any order is limited to the amount you paid for that order.

Privacy

How we handle your personal information is set out in our Privacy Policy. Our Information Officer is Willem Christiaan Reynders, registered with the Information Regulator under 2026-064957. Our PAIA manual is at /pages/paia-manual.

If something goes wrong

Please contact us first, on [email protected] or 072 522 7099. We answer complaints within two business days. If we cannot resolve it, you may refer the matter to the National Consumer Commission or the Consumer Goods and Services Ombud. Their details are on our Contact information page.

Changes to these terms

We may update these terms. The version published when you place an order is the one that applies to that order.

Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
