Creator Program Agreement
This is the deal between you (the Creator) and SA FitFoodz (Pty) Ltd ('FitFoodz', 'we', 'us'). It applies the moment you accept it during signup, or the moment you start using your code or program content β whichever comes first. Read it. We'll hold you to it; you can hold us to it.

1 Who can join
You must be 18+, South African based, with a verified Instagram or TikTok account that has 5,000+ followers and is at least 6 months old. Your niche must fit fitness, weight loss, lifestyle, food, student health, or wellness. You may not currently be in another meal-prep brand's affiliate program.
We approve on judgment, not just metrics. We may decline anyone, at any time, without giving reasons.
This is an independent contractor arrangement. Nothing in this agreement creates an employment, partnership, agency, or joint-venture relationship between you and FitFoodz. You're not an employee β you don't get UIF, paid leave, or any other employee benefit, and you handle your own taxes (see clause 6).

2 Joining
There's no joining fee and no box to buy. Once approved, you sign up on our affiliate platform (Simple Affiliate) and we issue your unique discount code. You also receive R3,000 in FitFoodz store credit to start (see clause 5).

3 Your unique code
After approval and affiliate signup, we issue you one discount code. The code is non-transferable. You may not:
- Share the literal code with people running other accounts.
- Post the code on coupon sites, deal aggregators, cashback apps, or paid traffic to landing pages outside your own channels.
- Use your own code on your own orders, or orders from your immediate household. Only first-time FitFoodz customers count.
Anti-abuse. We exclude any sale we identify as a self-referral (your own account, household, or alias), a fake-account signup, a VPN or proxy ring, or a refund-then-rebuy scheme. Repeated or deliberate abuse is grounds for removal from the program under clause 11.

4 Commission
You earn:
- 10% commission on the first order from any new customer using your code.
- 5% commission on every order that customer places after their first β for as long as you remain an active Creator (defined below).
Commission is calculated on the order subtotal (excluding shipping, taxes, and gift cards). 'New' means the customer's first ever FitFoodz purchase, identified by email or phone number. Once a customer is attributed to you via your code, repeat orders by the same customer count toward your 5% automatically β they do not need to re-use the code.
Active Creator status. In any calendar month, you must produce at least 3 first-time customer sales using your code. If you fall below that, your 5% repeat commission pauses at the end of that month and resumes the moment you hit active status again. The 10% on new customers continues to apply at all times while your code is active. The monthly store credit (clause 5) also requires you to be active.
Refunds, returns, chargebacks. If an attributed order is later refunded, returned, or charged back, the related commission is reversed by the affiliate platform and deducted from your earnings.
We verify in Shopify before paying. Flagged orders are reviewed manually; if they qualify, the commission is added to your next payout.

5 Monthly store credit
You earn R3,000 in FitFoodz store credit when you produce 3 first-time customer sales using your code in a calendar month. This is the same 'active Creator' bar from clause 4.
The credit is added to your FitFoodz account on the 1st of the following month, to spend on meals. It is use-it-or-lose-it: unused credit expires when the next month's credit is due. One award per qualifying month. It is store credit only β no swap for cash, no rollover. Miss a month and you simply don't receive credit for that month; make 3 sales again and it resumes.

6 Payouts
Commission is paid out automatically through Simple Affiliate, our affiliate platform, into the South African bank account you provide at signup. You can track your confirmed earnings and payout status anytime in your Simple Affiliate dashboard β that is the source of truth for amounts and timing.
The R3,000 monthly store credit (clause 5) is separate from commission and is added directly to your FitFoodz account as meal credit.
You are responsible for all SARS tax on your earnings β we do not withhold. If your annual creator income from us (plus any other non-salary income) exceeds the SARS provisional-tax threshold, you may need to register as a provisional taxpayer. This isn't tax advice; check with SARS or your accountant.

7 Content
Posting content is not a requirement for your commission or your store credit β those depend only on sales. But we strongly encourage it: more content means more sales, which means more earnings.
From time to time we'll share briefs or request specific videos or collabs in the creator WhatsApp group. When we don't, post about FitFoodz using your own creativity. When showing a paid partnership, tag @fitfoodz and disclose it per clause 9.

8 Content licence
You own your content. By posting it tagged @fitfoodz, you grant FitFoodz a non-exclusive, royalty-free, worldwide licence to repost, share, edit, crop, caption, and use it on any of our channels (Instagram, TikTok, our website, email, and organic or paid advertising on any platform) β with or without credit to your handle and without prior notice to you β while you remain in the program and for 12 months after.
You waive any moral-rights claim against reasonable editing or recontextualisation of your content for FitFoodz marketing, provided we don't materially misrepresent what you said.

9 How you talk about FitFoodz
Don't make medical, weight-loss, or specific health claims that aren't already on our official site. No misleading 'before/after' claims. No targeting minors with diet content.
Disclose the partnership clearly and upfront. Use #ad, #partner, or #FitFoodzCreator. The disclosure must appear at the start of the caption β not buried at the bottom or hidden behind a 'see more' fold. This is the ASA SA Influencer Marketing Code minimum and we'll hold you to it.
Don't bring FitFoodz into reputation risk: no hate speech, no illegal content, no coordinated harassment, no political endorsements that imply FitFoodz support.

10 Your responsibility & our liability
You're responsible for what you post and how you behave online. You confirm that:
- You have the right to post the content you make (you own it, or have written permission to use it).
- Your content doesn't infringe anyone else's copyright, trademark, or privacy.
- You're following ASA, ARB, and any other code your channel falls under.
- You're complying with clauses 3 (code), 7 (content), and 9 (how you talk about us).
You indemnify FitFoodz against claims, losses, and reasonable costs (including legal fees) arising from your content, your conduct, or your breach of this agreement.
Our liability is limited. FitFoodz isn't liable for indirect, consequential, or special damages. Our total liability to you under this agreement won't exceed the commissions actually paid to you in the 12 months before the claim. Nothing in this clause limits liability that can't be limited by law.

11 Ending or changing this agreement
You can leave any time. Email us at info@fitfoodz.co.za. Your code stops working immediately. Any commission already earned and verified is paid out through Simple Affiliate on its normal cycle, and any store credit not yet earned does not carry over.
We can end your participation any time, with or without reason. For-cause termination β fraud, material breach, the abuse cases in clause 3, or anything that brings FitFoodz into serious reputation risk under clause 9 β may result in forfeiture of unpaid commissions that haven't already accrued from completed customer sales. Commissions already earned and verified from completed sales remain payable, subject to any clawback under clause 4.
We can update these terms with 14 days' notice posted on this page. Continuing in the program after the change date counts as acceptance.

12 Privacy and data
We process your personal information per our Privacy Policy, in line with POPIA. We share your bank details only with our payment processor for the purpose of paying you.
What we collect: name, email, WhatsApp number, social handles, follower count, pitch content (link or video), bank details for payouts, and SARS info if your earnings exceed the SARS provisional-tax threshold.
How long we keep it: while you're in the program, plus 7 years after for SARS and audit purposes. Pitch videos you upload during application are kept while your application is open and for 12 months after. You can ask us to delete anything not required by law β email info@fitfoodz.co.za.

13 Disputes & contact
This agreement is governed by South African law. Disputes go to the courts of Potchefstroom (or the relevant Magistrate's Court if smaller). Try email first β info@fitfoodz.co.za β before going legal.
